With the legalization of cannabis in Canada in 2018, it is no longer considered illegal to possess or consume cannabis for recreational purposes. However, there are still legal rules and regulations in place regarding how much weed an individual can legally carry in Canada. In this blog post, we will discuss the laws and regulations surrounding the amount of cannabis an individual can carry in Canada.

Legalization of Cannabis in Canada

On October 17, 2018, the Cannabis Act came into effect, legalizing the use and possession of cannabis for recreational purposes in Canada. However, this does not mean that there are no restrictions on the amount of cannabis one can possess. The Cannabis Act outlines the rules and regulations surrounding the use, possession, distribution, and sale of cannabis in Canada.

How Much Weed Can I Legally Carry in Canada?

The Cannabis Act allows individuals in Canada to possess up to 30 grams of dried cannabis or the equivalent of non-dried cannabis in public legally. This is the maximum amount that an individual can legally carry without facing criminal charges. The equivalent amount is based on the potency of the product and can be determined using the following conversions:

1 gram of dried cannabis is equivalent to 5 grams of fresh cannabis

1 gram of dried cannabis is equivalent to 15 grams of edible product

1 gram of dried cannabis is equivalent to 70 grams of liquid product

1 gram of dried cannabis is equivalent to 0.25 grams of concentrates (solid or liquid)

It is important to note that the possession limit applies to individuals who are 18 years of age or older. It is illegal for individuals under the age of 18 to possess any amount of cannabis, even if it is less than 30 grams.

If an individual is caught with more than 30 grams of cannabis, they may face criminal charges. The severity of the charges will depend on the amount of cannabis in their possession, with penalties ranging from fines to imprisonment.

Transporting Cannabis in Canada

The rules surrounding the transportation of cannabis in Canada are different from the possession limit. While the possession limit applies to how much cannabis an individual can carry on their person in public, the transportation rules apply to how much cannabis an individual can transport in a vehicle or other mode of transportation.

In Canada, it is illegal to transport cannabis in a vehicle unless it is stored in a closed container that is out of reach of the driver and any passengers. This means that the cannabis must be stored in the trunk of the vehicle or a locked glove compartment. The amount of cannabis that an individual can transport in a vehicle is also limited to 30 grams of dried cannabis or the equivalent amount of non-dried cannabis.

It is important to note that transporting cannabis across international borders is illegal and can result in severe penalties. Even transporting cannabis between provinces or territories within Canada can be illegal if the transportation violates the laws of the destination province or territory.

Penalties for Possessing More Than the Legally Allowed Limit

As previously mentioned, possessing more than 30 grams of cannabis in public can result in criminal charges. The penalties for possessing cannabis in excess of the legal limit can range from fines to imprisonment, depending on the amount of cannabis in the individual’s possession.

If an individual is caught with more than 30 grams of cannabis but less than 50 grams, they may be charged with a summary conviction and face a fine of up to $1,000 or imprisonment for up to six months. If an individual is caught with more than 50 grams of cannabis, they may be charged with an indictable offense and face up to five years in prison.

It is important to note that these penalties apply to possession charges only. Distributing, selling, or trafficking cannabis can result in much harsher penalties, including longer prison sentences and larger fines.
